How a lawyer can help with your separation and divorce

Miller Law, in Waterloo, understands that a break-up is a very emotional time and when that break-up is from a marriage; the division of property and assets along with custody decisions and support agreements can make it a very confusing time as well.  When you and your spouse decide to legally separate or divorce it is a very sensitive matter that requires the assistance of a lawyer that is not only kind and compassionate but is experienced and able to help you in the best way possible.

Once you and your spouse have decided to separate it is advised to legally separate with a written agreement.  A separation agreement will ensure any decisions you and your spouse make are upheld in court.  Included in the agreement should be the decisions regarding the division of assets, the custody of your children, who the children will live with and when the other spouse will have access, as well as support payments. It is imperative that a lawyer helps you when negotiating the terms of the agreement as it is a legally binding agreement.   

You will also require the assistance of a lawyer when divorcing your spouse.  Divorce is the legal end to your marriage and it is required should you or your spouse want to remarry.  Divorces are either uncontested or contested.  An uncontested divorce means that you have an agreement in place already. If you and your spouse have been unable to agree to the terms of your separation then you will need to apply for a contested divorce.  For a contested divorce, the matters that you are unable to decide on will be determined in court.
